General Provisions

1. Appointment of Green Goat Maintenance

Green Goat Maintenance (hereinafter referred to as "the Facilitator") is hereby appointed to oversee trade works where the total cost does not exceed $3,300.00, inclusive of GST, per trade. Any proposed works exceeding this threshold shall be directly issued to the client as per QBCC requirements, with the Facilitator entitled to a Facilitation fee of $250.00 plus GST per trade.

2. Site Visit & Quotation Terms

A site visit by the insured installer is required for all QBCC tasks before a firm quotation can be provided. Prices may vary based on the installation requirements or the quantities of materials needed.

Acceptance of Estimate
By accepting this quote, you agree to the terms outlined. If payment is not received by the due date, any legal costs incurred to recover the outstanding balance will be added to the amount owed and are the responsibility of the client.

A $30.00 admin fee will be added to the total post 7 days overdue for every 7 day reminder sent.

3. Warranty and Insurance

All services performed by the various trades shall be covered under warranty and insurance provided by the selected trades as registered with the Queensland Building and Construction Commission (QBCC). The Manager shall not assume any liability for the facilitation of warranty or insurance claims related to the trade tasks executed.

4. Compliance with Terms

All agreed-upon trade tasks must adhere to the terms and conditions of payment specified in the relevant contractual documentation.

5. Property Ownership

All property, materials, and equipment supplied by the Manager shall remain the property of Green Goat Maintenance until all outstanding accounts have been settled in full.

6. Trade Variations

All trade variations to the work listed above will be discussed with the client and approved prior to competing the works.

7. Flooring

1. This Order assumes the sub-floor meets the required Australian Standard prior to installation.

2. Testing will be carried out for moisture content if deemed required, PH and planeness prior to the installation commencing. If testing determines that further floor preparation is required, then this will be quoted separately.

3. A temperature-controlled environment to acclimatize floor covering must be provided by the builder, building owner or end user in accordance with Australian Standards prior and during the installation process. This will be discussed with the interested parties as to the relevance/requirements of this at each situation.

TERMS AND CONDITIONS OF SUPPLY

Definitions

The following conditions shall apply unless otherwise agreed in writing.

"Agreement" means any agreement formed if this order is accepted;
"Business Day" means Monday to Friday excluding public holidays;
"Company" means Green Goat Maintenance;
"Customer" means the customer stated above, jointly and severally if there is more than one, acquiring goods or services from the Company;
"Goods" "Services" "Terms" means goods supplied by the Company to the Customer; means services supplied by the Company to the Customer; means these Terms and Conditions of Supply.

1.Green Goat Maintenance will be the supplier of the flooring materials and facilitate a final installation company. They will make every effort to complete the work by the estimated date of supply or installation, but it cannot be held responsible for delays due to circumstances beyond its control. In this case, the installer will complete the work as soon as reasonably possible. The customer, however, has the right to terminate the Agreement without penalty for unreasonable delays beyond the estimated date of supply or installation.

two payments are to be made. Materials and installation separate to the assigned companies. In addition to payment of the price of goods and services, the Customer must pay any GST, and any other taxes or duties imposed on the goods and services.

If the Customer requests any variation to the Agreement, the Company may increase the price to account for the variation.

4.

A part-payment may be required upon placement of the Customer's order if stated on the Order.

5.

Under Australian Consumer Law (ACL) once a contract is signed or accepted by both parties, it is legally binding. If the Customer cancels the order prior to work being commenced the Retailer is not obliged to offer a refund. If the Retailer chooses to offer a refund it will be less any reasonable costs (such as the manufacturers restocking fee, warehousing, packaging and freight costs etc.) incurred by the Company.

6.

Where the Customer work has commenced and the Customer cancels the contract, the Company reserves the right to retain part or all the Customer's part payment as a contribution to cover the Company's lost expenses and handling charges.

7.

If the Company is unable to supply all the order, any deposit paid by the Customer in relation to that supply shall be returned to the Customer.

8.

Unless otherwise agreed in writing the Company reserves the right to require payment in full on installation of the goods, or where there is no installation, upon delivery of the goods.

9.

If the Customer defaults in payment by the due date then all money becomes immediately due and payable and the Company may, without prejudice to any other remedy available to it:
(a) charge the Customer interest at the rate of 11% per annum until the date of payment in full;
(b) charge the Customer for all losses, liabilities, costs and expenses (including but not limited to debt recovery and legal expenses, including commission charged by debt recovery agents and solicitor's costs) on a full indemnity basis;
(c) cease or suspend supply of any further goods or services to the Customer;
(d) by notice in writing to the Customer, terminate any contract with the Customer so far as unperformed by the Company.

10.

Ownership of the goods on this order will not pass to the Customer until the invoice has been paid in full.

11.

The Customer shall provide, without expense to the Company, proper access to the site, including adequate light, water and power for the completion of the services.

12.

Unless otherwise stated in the "Description of Works" the Customer must at their own expense, uplift any existing floor coverings or window furnishings (if relevant), and clear the area on which the floor coverings are to be laid, including the moving of furniture and electrical and gas appliances (and any disconnecting and reconnecting required).

13.

Unless otherwise stated in the "Description of Works" the Customer will arrange for the removal, cutting and replacing of doors.

14.

The Customer accepts responsibility for all unforeseen costs and expenses incurred prior to work commencing such as increased transport or installation costs. If the Customer does not accept these additional costs, it may terminate the Agreement prior to work commencing.

15.

Non-stock items specifically ordered by the Customer cannot be returned for credit. This does not apply where the Company is found to be in breach of the Agreement or any of the implied statutory warranties under State and Commonwealth consumer protection legislation.

16.

If the Company is unable to supply part of an order, the Customer is entitled to cancel the entire Agreement.

17.

Pile reversal is a characteristic of appearance which has no detrimental effect on the durability or life of the carpet. Pile reversal is not a manufacturing defect and neither the manufacturer nor the Company can accept claims on carpet which may be affected by pile reversal, except in extreme cases of pile reversal where the manufacturer deems the carpet to be defective.

18.

The goods come with warranties under Australian Consumer Law.

19.

At the time of quotation, the Company must use its due care or skill to conduct an inspection of the floors and inform the Customer of any defects apparent at the time.

20.

Nothing in these Terms is to be interpreted as excluding, restricting or modifying the application of Australian Consumer Law.

21.

Reasonable skill and care will be exercised, however the Company will not accept responsibility for any loss or damage occasioned in the moving of household effects, nor for any damage caused to walls, skirting boards or paintwork, unless negligence

Turf and soft scaping

A deposit of 30% is required at the time of accepting the quote via either credit card or direct deposit. Project dates and landscape services will not be held without payment. We may request an interim payment for complex/specialty projects.

Full payment is required on the day of project completion.

2. Payment Terms: Supply Only OR Supply and Lay: Full payment for all turf orders and laying is required no later than 9am on the business day before delivery. Turf cannot be harvested without prepayment.

3. Cancellation & Refunds: Preparation, Supply & Lay: In the event you need to cancel your lawn project after the deposit has been paid a cancellation fee of $300.00 will apply and will be retained from 30% deposit paid. Any costs to the project already expended e.g. lawn sprayed or soil supplied, will also be retained by us or will need to be paid for in the event the deposit does not cover all costs incurred by us.

4. Cancellation & Refunds: Supply Only OR Supply & Lay: Orders cancelled prior to turf being harvested will not incur any cancellation fees. Turf orders that have been harvested will still need to be paid for if turf cannot be used to fulfill other orders as it cannot be re-planted. Green Goat Maintenance will do all possible, to re-allocate harvested turf but makes no guarantees. Refunds processed back to the original method of payment within 7 days. In the event you need to cancel your project and turf has been harvested there is no refund on that component as it cannot be re-planted. Green Goat Maintenance will do all possible, to re-allocate harvested turf but makes no guarantees.

Chemical Use: Should your project require existing grass/weeds to be removed our landscape contractors will use Glyphosate to kill off the grass. Our contractors will spray Glyphosate according to both the manufacturers recommendations and according to the guidelines set out in relevant Workplace Health and Safety Legislation. Should you prefer not to have Glyphosate used you will need to arrange your own alternative, but Green Goat Maintenance holds no responsibility for the success of the application, which is critical to a successful lawn installation.

8. Variations & Additional Works: Variations and additional works to plans etc. must be quoted by us and approved in writing by the client before these works can be carried out. All services need to be located and clearly marked by the client. No allowance for excavation of rock, unless specifically noted above. All goods and materials remain the property of Green Goat Maintenance until paid for in full. Please note, additional fees may apply should our contractors come across anything that cannot be identified until excavation of site begins when we break the surface e.g. uncover concrete, tree stumps, builders' rubble etc. In the event this should occur, Green Goat Maintenance will liaise with you prior to proceeding with works to gain consent for any additional costs that may be incurred because of their findings. Please ensure if you live in a Body Corporate or live in an estate that there are no caveats on the type of turf you can install at your property. If there are, please advise our Project Consultant immediately so we can amend your quote to suit, if required.

9. Delivery: We will call you between 2-4pm the day before delivery to advise an estimated delivery time for the following day. We can take requests for AM or PM deliveries and every effort will be taken by our logistics team to meet that request however Green Goat Maintenance can make no guarantee of delivery time. This is particularly unavoidable in peak periods or after prolonged periods of wet weather. Unfortunately, placing orders well in advance also doesn’t guarantee you a timeslot. However, as we utilise Contractors, we have one of the most flexible delivery services in SE QLD and will endeavour to do our best to accommodate your needs. Our turf layers often do multiple projects in one day. This means they may not arrive on site at the same time as the turf delivery. Rest assured, they will co-ordinate all jobs to be completed on the same day as delivery.

10. Weather Wet weather can and does impact projects. Both the ability to prepare the area, source materials such as soil and our ability to harvest and deliver our turf. We do carefully monitor weather and potential impact to our ability to harvest and install turf. We aim to maintain communication with our customers at all times. If it is too wet to harvest turf for your project, we will liaise directly with you and the project consultant to reschedule the project. We appreciate this can cause disruption and disappointment to our customers, but weather is an environmental factor outside of our control. We will complete your project at the very next available opportunity.

11. Workplace Health & Safety: Our Project Consultants will conduct a Site Assessment and Dial before you Dig (if applicable) prior to commencement of any works. If there are any known hazards that may cause harm to our consultants, occupants (including animals), pedestrians or illegal underground power cables, please ensure you remove these risks or ensure the Project Consultants are fully aware of these risks prior to project commencement.

12. Site Access & Damage on Site: Acceptance of this quote means the customer allows us to travel over the driveway and into your property if required. All care will be taken but we are not responsible for any damage to property. Whilst this has not been an issue in the extensive years we have been trading; Green Goat Maintenance holds no responsibility for security of your possessions whilst Contractors are on site. If you direct our drivers to place the turf in an area and they have expressed concerns about, then any damage and costs incurred by the driver and/or to recover equipment may be borne by you.

13. Fire Ants Our Projects Consultants will comply with all Fire Ant Regulations, however if you are aware that you have Fire Ants, please make this known to our Projects Consultants as this will ensure the quote is accurate. In the event we find Fire Ants during your project, we may need to complete other works that may incur additional fees.

14. Sign Off & Handover:

Your satisfaction at the completion of the project is of utmost importance to us. Our project consultants, landscapers or layers will ask you to sign off on works completed to ensure work has been completed as per quote and to a quality finish. The site will be left as clean as possible and minimal scrap turf removed. Please note we do not gerni or hose clean driveways or pathways after project completion, as water usage is at a cost to you. No debris or rubbish from our Contractors will be left on-site however neither will they be responsible for any other Builders or Contractors or your personal debris or rubbish.

15. Warranty: Other's turf farms may offer a 10-year warranty on their turf. But, did you know, this warranty must be redeemed within 8 hrs of turf being delivered? At Green Goat Maintenance and Glenview turf, our turf providers don’t offer a 10-year warranty, but they do pride themselves on customer satisfaction with turf whether it's 8 hours or 8 weeks old. We warrant the turf delivered to you in good condition and will rectify any poor supply of turf. The success of the turf post-delivery is dependent on the area having been prepped adequately, timing of laying the turf and post installation maintenance by the client. We will supply you with maintenance support information when you place your order. We are also available to you for years to come, if you have any questions or require advice on maintenance. We can also support you with a Free Lawn Health Check at the 4–6-week mark if you request one in writing to us. It is the responsibility of the customer to ensure that the variety of turf selected is fit for purpose in the area intended to be turfed. I.e. ensuring a shade tolerant turf is selected for a shaded area.

16. Post Installation Care: Client MUST water the new turf twice a day for at least 2-4 weeks for the best result. This includes on the day of and immediately after installation and all public holidays e.g. Christmas Day if installed within 4 weeks of Christmas. Please refer to your watering guide. This quote does not include watering or post installation maintenance. Watering is critical to the survival and sustainability of your lawn. If you have any queries, ask your Green Goat Maintenance agent. IMPORTANT: Do NOT allow anyone to walk on the new turf for 2-4 weeks. Green Goat Maintenance recommends the use of Caution Tape however we do not provide.

Exclusions

The price quoted by the Facilitator shall exclude:

Delays Beyond Control Any delays resulting from circumstances beyond the Manager's control, including but not limited to adverse weather conditions, actions taken by the client or third parties, and the procurement of necessary permits and approvals.

Supply Chain Variability Green Goat Maintenance shall employ reasonable efforts to ensure a continuous supply of materials. The pricing and scheduling outlined in this proposal are contingent upon standard supply chain availability. Any delays or increased costs arising from epidemics or pandemics shall be considered a variation to the original terms.

Cranage, Lifting, and Scaffolding All costs associated with cranage, lifting, and scaffolding shall be excluded from the proposed price.
